Virtu SIM Ltd., (ЕИК: 208046133, Вирту СИМ, БЪЛГАРИЯ, гр. Стара Загора, ул. Майор Таньо Кавалджиев, 177, ет. 4), doing business as Virtusim (www.Virtusim.net) (“Virtusim,” “we,” “us,” or “our”), provides eSIM services for customers around the world. These Terms and Conditions (“Terms”) govern your use of our products, services, mobile application (“App”), and website (“Site”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. VALIDITY OF TERMS AND CONDITIONS

These Terms constitute a legally binding agreement between you (“Customer”) and Virtu SIM Ltd. By registering for an account, downloading the App, or using our Services, you indicate that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you may not use the Services. If you accept these Terms on behalf of your employer or another legal entity, you represent that you have the authority to bind such entity to these Terms.

2. DESCRIPTION OF SERVICES

Virtusim provides eSIM solutions to enhance connectivity worldwide. Our Services include:

• Digital eSIM cards for mobile connectivity.
• Data, voice, and text packages for multiple regions and countries.
• Support for eSIM-compatible devices.

To use our Services, you must:

• Have an eSIM-compatible, unlocked device.
• Register for an account and provide accurate information.

Virtusim disclaims any liability for interruptions, delays, or faults caused by third-party providers or circumstances beyond our control.

3. REGISTRATION AND ACCOUNT

To access certain features, you must create an account (“Account”) and:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of unauthorized account access or other security breaches.

You are solely responsible for all activities under your Account, even if unauthorized.

4. CHARGES AND PAYMENT

All fees for eSIM packages and related services are displayed during checkout. Payments must be made using the methods provided. By purchasing our Services, you agree to:

• Pay all applicable charges and taxes.
• Understand that purchases are non-refundable, except as outlined in our Refund Policy.
• Allow us to charge your preferred payment method for recurring fees, if applicable.

4.3. Invoicing

Virtusim issues invoices for business users detailing all transactions, including purchases and service usage. Business users are responsible for timely payment as per the invoice terms. Late payments may result in interest charges and service suspension.

4.4. Prepaid Transactions for Business Users

Business users may prepay for services using Virtusim Credits. These credits can be applied toward eSIM purchases, top-ups, and other services. Unused credits are non-refundable.

4.5. Postpaid Transactions for Business Users

Virtusim offers postpaid options for eligible business users, subject to a credit limit. Payments are due as per the terms outlined in the invoice. Non-payment may result in service suspension and additional charges.

5. DELIVERY

Purchased eSIMs are delivered digitally and made available under the “My eSIMs” section of your Virtusim account. Activation instructions are provided with the purchase. You are responsible for activating the eSIM within the validity period.

6. REFUND / CANCELLATION / MODIFICATION POLICY

Refunds

Refunds may be issued under the following conditions:

• If you are unable to use the Services due to an error on our part.
• If you request a refund within 30 days of purchase and provide a valid reason.

Cancellations

You may cancel a subscription or service before activation or use. Fees already incurred may not be refunded unless otherwise stated.

Modifications

You may request changes to your eSIM plan before activation. Approval of such requests is subject to Virtusim’s discretion.

7. USE OF DIGITAL CURRENCIES (AIRMONEY & CREDITS)

Virtusim offers Airmoney for personal users and Credits for business users as digital payment methods.

Airmoney

• Earned through promotions or referrals.
• Can be used for eSIM purchases but cannot be exchanged for cash.

Credits

• Prepaid by business users for transactions on the Virtusim platform.
• Non-refundable and valid only for Virtusim services.

8. INTELLECTUAL PROPERTY

All content, trademarks, and intellectual property associated with the Services are owned by Virtusim or its licensors. You may not use, copy, or distribute any materials without prior written consent.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Virtusim is not liable for:

• Indirect, incidental, or consequential damages.
• Loss of data, revenue, or business opportunities.
• Issues caused by factors outside our reasonable control.

10. DATA PRIVACY

Your personal information is processed in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to the collection and use of your data as outlined in the Privacy Policy.

11. MODIFICATIONS TO TERMS

Virtusim may update these Terms from time to time. Changes will be posted on our Site with the updated effective date. Continued use of the Services after changes are made constitutes your acceptance of the revised Terms.

12. GOVERNING LAW

These Terms are governed by the laws of Bulgaria. Any disputes arising under these Terms will be resolved in the courts of Stara Zagora, Bulgaria.

13. NOTICES AND CONSENT TO RECEIVE NOTICES ELECTRONICALLY

By using Virtusim Services, you consent to receive all notices electronically. Notices may be delivered via email, in-app notifications, or updates on our website. Ensure your contact information is accurate to receive timely updates.
